Eric & Lila Make it to the Supreme Court of Ohio!

In the Supreme Court of Ohio - Case No. 2025-0458 N. Canton Dept. of Dev. Servs. v. CF Homes, L.L.C  

On January 8th, 2025 oral arguments were held to determine if cities in Ohio can enter your private property without a warrant or if they can get a warrant without showing just cause.  The city argues that this is not a criminal case so the 4th amendment does not apply.  At the 36 minute mark the Chief Justice questions "If you have committed a crime are you entitled to more constitutional protection than if you are a law abiding United States citizen?"

The city admitted in arguments that they their probably cause was that the property was "Aging" and that the property had never been "Searched before." 

It was questioned what other "Schemes" could be used to get in the door. 

I encourage you to listen to the whole 49 minutes or at least the first 12 to hear our case.

UPDATE: Waiting for the court's decision to see if Law abiding citizens are afforded the same rights to their property as suspected criminals... Or if these rights are lost just because they happen to rent their homes or because the city decided it wanted to search a property even though they had no probably cause.

 

Legislative Updates: Ohio HB92 moves to House floor

Lila Testifies to the House Committee in support of HB93 (the 2023-2024 version of this bill)

Now it is HB92 & SB118 for the 2025-2026 session.

On June 11th, 2025 Deven testified in support of the Senate companion bill to HB92, SB 118. He starts at 23:28.

The bill prevents municipalities from attaching a lien on properties from services that were contracted for and used by tenants.  It prevents property owners to be payers of last resort. It only makes sense to have utility bills paid for by those who use the services. Water, sewer, and trash services should not be treated differently than other utilities.

As a housing provider in this state, when I am hit with unexpected bills or liens on my property for services I didn't contract for or use, it makes it difficult for me to keep my rents reasonable and my deposits low.  These extra charges must be socialized across other properties that are rented by good and paying tenants.

If you want to know why this is so important to pass, here is a phone call with Alliance Water Department.  Currently there is NO WAY to limit your liability for a utility that you did not contract for, did not use & cannot turn off.

Summary:  Another federal judge ruled this week that the CDC lacked the authority to issue a nationwide moratorium on rental evictions. U.S. District Judge J. Philip Calabrese wrote in a 31-page order that the agency went beyond what the federal Public Health Service Act allows it to do. The ruling was hailed as a victory for landlords who have suffered financially during the pandemic.
